Illegal Store Mask Mandates

The mask mandates are illegal. There is no law in the state of Florida that requires us to wear face coverings in stores. I put this page together in the hopes that for those of you who know that the face coverings not only do not protect us nor anyone else from Covid-19 but that you do not have to wear one and neither stores or your employer can legally mandate you to wear one. Feel free to contact me for questions or to tell me if I am in error. I could not find a single law or emergency executive order stating that we must wear face coverings in our state. I got a ton of information from this website.

-What to say –

OPTION 1 if someone whether store employee or customer of that store gets hostile

STAY CALM! Walk in with confidence because you are not breaking any laws.

Ask (if not employee): Are you harassing me? Because if you are I will need to call law enforcement (see Lee county sheriff’s number below). Tell them you are not currently breaking any laws.

If employee:  This place of business cannot create a store policy that violates established law. (show them below “Message for Stores that refuses entry (medical)”)

Option 2: Don’t say a word method.

I hereby again claim my own medical exemption, and I’m not required by law to tell you my medical history, nor are you allowed to ask, because of medical privacy laws protected by HIPAA

You are violating the ADA Act, the Americans with Disabilities Act, that requires that you make reasonable accommodation to those with disabilities that could include numerous medical disabilities that could prevent people from wearing masks, such as, but not limited to, the following: asthma, allergies, anemia, fungal infections, blood clotting disorders, diabetes, PTSD, autism, pre existing lung problems, “being a human”, and needing to meet basic OSHA air quality requirements of more then 19.5% oxygen, and less then 400 parts per million CO2. Masks have been shown to reduce oxygen to 18% and increase CO2 to over 10,000 ppm.

The ADA(see below) also requires you to make reasonable accommodations for people with a religious exemption to wearing masks, because discrimination based on religion is also illegal.

Message for Store that refuses entry (medical)

  1.  A licensed medical professional is the only person qualified to give medical advice, including the advice to wear a mask, which negatively affects the respiratory system, neurological system and immune system. 
  2. Practicing medicine without a license is an offense punishable by law.
  3. There is no law in Florida that requires anyone to wear a mask into any business establishment. Guidelines are not laws. 
  4. Equal access and accommodations in any business establishment whatsoever is protected by law. No citizen may be discriminated against based on health condition.
  5. Any threat of intimidation in this matter will result in law enforcement being summoned.;

State of Florida does not have mask mandates that I could find.

Feel free to correct me if I’m wrong. So as far as I can tell it’s only businesses that are mandating masks which is illegal.

Page 1 says “Advising individuals to wear coverings where social distancing isn’t possible”

Page 2 “All individuals in Florida should wear face coverings in any setting where social distancing is not possible, unless any of the following is applicable:”

  • A child is under two years of age;

  • an individual has one or more medical conditions or disabilities that prevent wearing a face covering;

  • An individual works in a profession where use of a face covering will not be compatible with the duties of the profession; or

  • An individual is engaged in outdoor work or recreation with appropriate social distancing in place.

  • All individuals should follow CDC guidelines on what type of face coverings are available and should be utilized.
